By accessing or using the TOPO MAPS+ website, the TOPO MAPS+ Apps, or any applications (including mobile and desktop applications) made available by TOPO MAPS+ (together collectively, the "Application" or "App" or "Apps), regardless of the type of access you choose, you agree to be bound by these terms of use ("Terms of Use"). These Terms of Use affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, please do not access or use TOPO MAPS+.

Please read this document in it entirety to learn the rules and restrictions that govern your use of our website(s), products, services and applications (the "Services"). THE TOPO MAPS+ APPLICATION FROM GLACIER PEAK STUDIOS LLC IS INTENDED FOR ENTERTAINMENT PURPOSES ONLY. GLACIER PEAK STUDIOS LLC MAKES NO GUARANTEES, REPRESENTATIONS OR WARRANTIES (EXPRESS OR IMPLIED) RESPECTING THE RELIABILITY OF THIS APPLICATION OR ANY GPS DATA. THIS PRODUCT IS NOT SUBJECT TO REVIEW, OR TESTED, APPROVED OR CERTIFIED BY, ANY GOVERNMENT OR PRIVATE AGENCY FOR USE IN CONNECTION WITH (1) NAVIGATION OR AVIATION ACTIVITIES, (2) LIFE SAFETY ACTIVITIES, (3) MOTOR OR OTHER VEHICLES OR VESSELS OF ANY KIND, OR (4) ANY OTHER PURPOSE OR USE. ANY USE OF THE TOPO MAPS+ APPLICATION FOR ANYTHING OTHER THAN ENTERTAINMENT PURPOSES, INCLUDING FOR ANY ACTIVITY IN WHICH THE USER’S HEALTH OR SAFETY IS POTENTIALLY AT RISK AND FOR WHICH THE ACCURACY OR RELIABILITY OF GPS AND MAP DATA IS CRITICALLY REQUIRED, COULD RESULT IN DAMAGE TO PERSON OR PROPERTY, UP TO AND INCLUDING INJURY OR DEATH. GLACIER PEAK STUDIOS LLC SPECIFICALLY DISCLAIMS ANY AND ALL LIABILITY, INCLUDING WITHOUT LIMITATION, CONSEQUENTIAL AND INCIDENTAL DAMAGES THAT MAY ARISE IN ANY WAY FROM THE USE OR RELIANCE ON THE TOPO MAPS+ APPLICATION OR RELATED DATA.

GLACIER PEAK STUDIOS LLC MAKES NO GUARANTEES, REPRESENTATIONS OR WARRANTIES (EXPRESS OR IMPLIED) RESPECTING THE RELIABILITY OF THE MAP DATA. USGS MAPS CAN BE UP TO 60 YEARS OLD. IT IS THE USERS RESPONSIBILITY TO INDEPENDENTLY VERIFY THE ACCURACY AND RELIABILITY OF ALL MAP DATA AND CONDITIONS.

GLACIER PEAK STUDIOS LLC MAKES NO GUARANTEES, REPRESENTATIONS OR WARRANTIES (EXPRESS OR IMPLIED) RESPECTING THE RELIABILITY OF USING TOPO MAPS+ WHILE OFFLINE. IT IS THE USERS RESPONSIBILITY TO (1) DOWNLOAD THE APP; (2) DOWNLOAD MAPS; (3) CONFIRM ACCURACY OF MAPS WITH LOCAL RANGER OR RECENT MAP PUBLICATION; (4) OBTAIN A PRINT COPY OF THE MAP; AND (5) NOT RELY ON TOPO MAPS+ FOR ONLINE OR OFFLINE USE IN ACCORDANCE WITH THE TERMS ABOVE.

NO WARRANTIES: TOPO MAPS+ MAKES NO OTHER WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR CONFORMITY TO ANY REPRESENTATION OR DESCRIPTION, WITH RESPECT TO THIS PRODUCT OTHER THAN AS SET FORTH HEREIN.

LIMITATION OF LIABILITY: THE MAXIMUM LIABILITY OF TOPO MAPS+ SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID FOR THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPO MAPS+ IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY.

THESE TERMS AND CONDITIONS DO NOT ALTER OR DETRACT FROM APPLE’S LICENSED APPLICATION END USER LICENSE AGREEMENT.

When you purchase a National Geographic map within Topo Maps+ you will be able to use that map as long as you keep that map on your device. You will also be able to use National Geographic maps that are restored from a backup of your device. In the event that Glacier Peak Studios LLC no longer has a contract with National Geographic, you will no longer be able to download your purchased National Geographic maps. You will not be able to share, export, or print National Geographic maps purchased within Topo Maps+. National Geographic maps can only be used with the Topo Maps+ account that originally made the purchase.
